TERMS AND CONDITIONS

1. General provisions

Our terms and conditions, in the version valid at the time of order, apply to all orders for goods placed by consumers on our website us.komperdell.com/en/. It is agreed that these terms and conditions will have exclusive application. Divergent terms and conditions applied by the customer, even if we do not contradict them, are not accepted by Distribution North America Camaro USA, LLC.

2. Conclusion of contracts

When you order goods which we offer on our websites, your contractual partner is Distribution North America Camaro USA, LLC, 1021, 39th Avenue SE, Puyallup, WA 98374, USA.

By clicking on the „Complete Payment“ button you place a binding order for the items in the shopping cart. We will confirm the receipt of your order by email immediately after you send the order. A binding contract is only concluded upon receipt of this order confirmation.

3. Delivery of goods

Please note that the ordered goods will only be delivered once we have received payment of the full purchase price and the shipping costs.

If working days are indicated as deadlines for delivery, this means Monday to Friday, with the exception of public holidays.

4. Prices

The prices listed in the offer at the time of the order will apply. The indicated prices are final prices (gross prices). Accordingly, these include the applicable statutory value-added tax.

5. Shipping costs

Basically the customer bears the shipping costs.

The amount of the shipping costs depends on the address to which the goods are sent.

For the shipping of particularly bulky, heavy or valuable items, different shipping charges may apply, which we will indicate for each product individually on the product detail page and on the order page during the purchase process.

6. Payment

You can pay by credit card or Apple Pay. With every order we reserve the right not to offer certain payment methods and to require other payment methods. The customer bears the cost of any financial transaction.

The purchase price is always due upon conclusion of the contract. If you purchase by credit card, your credit card account will be debited with order placement.

You agree to receive invoices, credit notes and reminders in electronic or paper form.

7. Reservation of title

The goods remain our property until full payment of the purchase price, including shipping costs.

8. Legal right of cancellation/withdrawal

Cancellation policy

You have the right to cancel this contract within fourteen days without giving reasons.
The period of cancellation is fourteen days from the date on which you or a third party appointed by you who is not the carrier,

took possession of the goods (in the case of a sales contract for goods supplied in a single delivery); or
took possession of the last goods (in the case of a contract for several goods that you have ordered as part of a single purchase order and that are delivered separately); or
took possession of the last partial consignment or unit (in the case of a contract for the delivery of a product in several partial consignments or units); or
took possession of the first delivery (in the case of a contract for the regular delivery of goods over a specific period of time).

by means of a clear declaration (e.g. a letter or email) about your decision to cancel this contract. You can use the attached sample cancellation form, but this is not mandatory.
In order to comply with the cancellation period, it is sufficient if you send the notice of the exercise of your right of cancellation before the expiry of the cancellation period.

Consequences of the cancellation

If you cancel this contract, we will refund all payments we have received from you, including delivery costs (except for the additional costs resulting from your choosing a delivery method other than the cheapest standard delivery offered by us), immediately and at the latest within fourteen days from the day we receive notice of your cancellation of this contract. We will use the same means of payment for the refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this refund.

You must return or hand over the goods to us immediately and in any case at the latest within fourteen days from the day on which you inform us of the cancellation of this contract. The deadline will be met if you dispatch the goods before the expiry of the fourteen-day deadline.

You bear the direct costs of returning the goods.
You will only be liable for any loss in value of the goods if such loss in value is due to handling of the goods which is not necessary for checking the nature, properties and functioning of the goods.

Please note that the right of cancellation expires prematurely for contracts for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

9. Refunds

We will automatically arrange for any refunds to be made to the account you use for payment. If you paid by Apple Pay, Google Pay or credit card, the refund will be made to the associated Apple Pay, Google Pay or credit card account.

10. Legal warranty

Your warranty claims are subject to the applicable statutory provisions.

For a period of 1 year after the initial date of production, Camaro USA, LLC will repair this product at no charge as long as the product has not suffered accidental damage, abuse, abnormal wear and tear, or misapplication. Such damage will be repaired at the purchaser‘s expense. Opening or altering the product in any way voids this warranty.

In consideration of the above promises by Camaro USA, LLC, the buyer agrees to and accepts the following conditions:
That this warranty is in lieu of all other warranties, expressed or implied
That ALL warranties of merchantability or of fitness for a particular purpose are hereby excluded and/or waived. - That the buyer‘s sole remedy shall be to obtain replacement of the product or a repair free of charge from Camaro USA, LLC.

And That this remedy is in lieu of all other remedies or claims for dama-ges, consequential or otherwise, which the buyer may have against Camaro USA, LLC. Camaro USA, LLC shall have no liability for any loss or injury caused, in whole or in part, by its actions, omissions, or negligence, or for contingencies beyond its control.

This warranty extends only to you, the original purchaser. It is not trans-ferable to anyone who subsequently purchases the product from you.

10.1. Three-year free repair service

In addition to the legal warranty, Distribution North America Camaro USA, LLC offers you on certain products according to our website a free repair service for three years. The three years apply from receipt of the goods. Shipping to Camaro USA, LLC will be at your own expense. For all other products the statutory warranty period of 2 years is applicable.

11. Severability clause

Should individual clauses of these terms and conditions be completely or partially invalid, this will not affect the validity of the remaining clauses or the remaining parts of such clauses, as well as the contract as a whole. Any invalid provision will be replaced by a provision which comes closest to the economic purpose of the invalid provision and is effective.

12. Miscellaneous provisions

You can view these terms and conditions at us.komperdell.com/en/. You can also print or save them by using the usual functions of your Internet program.

You can also archive the general terms and conditions and the data of your order simply by saving the general terms and conditions and saving the data summarized on the last page of the order process in the Internet shop with the help of the functions of your browser. In addition, you will receive an automatic order confirmation, which we will send to your email address after completion of your order. This order confirmation email contains the data of your order and can be easily printed out or saved with your email program.
